Collaborative Law

Mediation

Mediation is more widely used and often court required process in which two parties work with one neutral professional, a mediator, to resolve their conflict. Mediation is a cost-effective negotiation process.

Traditional Litigation

This is the traditional court process. A case is filed and parties go through various discovery and negotiation processes. If the parties cannot settle, the ultimate decision-maker is a judge or arbitrator. Nine times out of ten, parties settle their cases.

Cooperative Law

This is a blend of traditional litigation and collaborative law. A case can be pending while parties agree to work cooperatively to reach a settlement. If a settlement is not reached, the parties may proceed to court for resolution.

Attorney Assisted Negotiation

In cases that only involve spousal support or division of property, courts are requiring parties to participate in some form of alternative dispute resolution. DBMA offers assistance with these types of negotiations by phone or in person.

Premarital, Cohabitation and Postnuptial Agreements

Any couple who brings personal or business assets to the marriage can benefit from a prenuptial agreement. Prenuptial agreements are advantageous because they preserve the expectations of the parties and prevent surprises in a divorce. These agreements can also make specific provisions for future income, property, inheritances and debt. Options are virtually limitless in a prenuptial agreement, except for limiting child support, child custody and visitation. Cohabitation and postnuptial agreements are also beneficial. While not covered in state statues, they are enforceable.
